WELCOME TO THE SHIFACOLLECTIONS.CO.UK WEBSITE TERMS & CONDITIONS. PLEASE READ THEM CAREFULLY BEFORE PLACING YOUR ORDER. BY USING THIS WEBSITE AND/OR PLACING AN ORDER YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET OUT BELOW.
These terms and conditions set out the basis on which you can use our website, to place orders for items from shifacollections.co.uk. By ordering/purchasing goods from shifacollections.co.uk you are deemed to have understood and accepted these terms.

You may contact us at this address or by e-mail at email@example.com or phone us on +44(0)203 6330755 Telephone calls to and from Shifa Collections may be recorded and monitored as part of our efforts to further improve service to our customers. Unless stated otherwise, all calls to Shifa Collections are at your normal local landline charge. Mobile providers and other networks may vary.
We may contact you for marketing purposes by e-mail, mail or telephone with relevant offers.
All risk in the products we supply to you, in particular the risk of any loss or damage, shall pass to you on delivery of the products to the address you specify in your order. Ownership of the products shall not pass to you until we have received payment in full in respect of such products.
Measurements given are approximate as all our garments are hand produced.
All items are subject to availability. Catalogue items may vary slightly in colour due to photography and printing process. A garment may from time to time have variations in patterns/colours due to individual dyeing methods. We shall not be liable for any indirect losses you may suffer, including any loss of profit, income or anticipated savings, as a result of our failure to comply with these terms.
These terms constitute the entire terms on which we will provide products to you and cancels and supersedes all prior arrangements and representations, whether verbal or written.
We may amend these terms from time to time at our discretion without notice to you. Any amendments will be posted on this website and will supersede any terms and conditions previously published by us.
No delay or failure by ourselves in exercising or enforcing any of our rights or remedies under these terms shall operate as a waiver of those rights.
If any one or more of the provisions of these terms should be held by any court to be unenforceable, such provision shall be validly restated to as nearly as possible approximate the intent of the clause and, if such clause cannot be restated for any reason, shall be severable from these terms and deleted.
You may not assign or sub-contract any of your rights or obligations under these terms to any person without our prior written consent. No third party shall be entitled to enforce any of these terms whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.
All matters concerning and incidental to any offer or agreement for the purchase and sale of products from our website shall be in English and construed and governed according to English law and the English courts shall have exclusive jurisdiction in all such matters.
We do our best to make sure that prices are correctly shown, but very occasionally an error may occur. If this should happen, we will correct the price and ask you to confirm whether you still wish to purchase the products at the correct price. If we are unable to contact you, we will treat the order as cancelled. We will not accept an order if there is a pricing error.
We do not allow a resale on any of our items.
The content, the trademarks, nor any other portion of the website may be used reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited in full, or in part, for any purpose without our prior written consent.
If you are not happy with any product we supply you can return the item for a refund. Please refer to Delivery and Returns section of this website.
shifacollections.co.uk reserves the right in its sole discretion to refuse service at any time. Sale of any goods or services is subject to availability.
THESE TERMS AND CONDITIONS DO NOT IN ANY WAY AFFECT YOUR STATUTORY RIGHTS
Our display of products on our website is an invitation and not an offer to sell those products to you.
An offer is made when you place the order for your products. However, we will not have made a contract with you until we accept your offer.
We take payment from your card when we process your order and have checked your card details. Products are subject to availability. If we are unable to supply the products, we will inform you of this as soon as practical. A full refund will be given if you have already paid for the products.
If you enter a valid e-mail address we will send you an order confirmation e-mail and order update e-mail(s).
Unless we have notified you that we do not accept your order, or you have cancelled it, order acceptance and the creation of the contract between you and us will take place at the point the products you have ordered are dispatched from our warehouse to be delivered to the address you have given us. It does not take place until that stage, even though we may have debited your card, or we have sent confirmation e-mails. Very occasionally an error may occur resulting in the products described on our website not being the products actually available for sale. If this occurs, your order will not be, nor have been, accepted. We may ask you whether you wish to purchase other available products or the products which may have been dispatched to you in error. If so, your order will be amended. Otherwise, we will treat any order as cancelled, and any incorrect products dispatched will be returned for full refund.
The contract will be formed at the place of dispatch of the products.
All orders that you place on this website will be subject to acceptance in accordance our terms and conditions.
We do not file details of your order for you to access. Please print out these terms and conditions and the order acknowledgement for your own record.
Payment may be made by any single one of the methods indicated on our website; we are unable to process orders with more than one method of payment. We accept all major credit cards as logos on our website.
For security purposes your billing name and address must match that of the Credit/Debit card used for payment. We reserve the right to cancel and refund any order that does not match these criteria, once the information has been received from your bank or payment authority.
The price displayed for goods and services remains the same regardless of the country of delivery. All prices displayed for good on our website do not include VAT as we are not a VAT registered company. For deliveries outside the EU, the price remains the same as no VAT is charged and customers are not entitled to any VAT refunds as price do no not include VAT
A delivery charge will be applied at checkout, please refer to our Delivery Section on our webpage.
We deliver to any UK address as well as providing International Delivery. Please see our Delivery section for the country list and prices. All orders for international deliveries are subject to our Terms and Conditions. We do not deliver to PO Boxes; orders placed for these addresses will be cancelled and a full refund will be given if you have already paid for the products.
Orders require a signature to acknowledge delivery. The signature of the person accepting delivery at the delivery address will be proof that delivery has been received by you or the person, to whom the order is addressed. If no one is available to accept the delivery you will receive a card to advise that a delivery has been attempted.
A delivery charge is applicable for standard delivery in England, Wales and parts of Scotland. Please see our Delivery Section for full costs.
All delivery deadlines will depend on the address details supplied and stocks being present at time of dispatch. If the items selected are out of stock, you will be notified by telephone or e-mail. If there are any discrepancies in your order we will contact you, so please be sure to provide correct contact numbers with area codes, as well as an e-mail address.
We DO NOT offer Next Day or Timed Deliveries to any UK address. No compensation will be given for late deliveries. If however you have not received your delivery within five working days, please contact our customer support on firstname.lastname@example.org
We attempt to deliver all orders to the specified delivery address. However if a customer is not at home a card will be left and the parcel will be delivered to a Neighbour, Post Office or returned back to the depot. It is the customer's responsibility to collect it or arrange re-delivery. We will only deliver to the registered card address. If you would like the delivery to be left with your neighbours, please add these instructions at the checkout. A signature is required on delivery.
If you are not in on the first delivery attempt, a card will be left by our courier company. Another attempt will be made the following working day, unless otherwise advised by you. After 2 unsuccessful delivery attempts, further delivery attempts will be chargeable or alternatively, the parcels can be collected from the local courier depot. Details can be found on card left.
If a courier is unable to deliver a parcel after several attempts or it is rejected, it will be returned to us. We will then apply an additional charge of £6.00 to cover the costs we have incurred in connection with the undelivered parcel.
PLEASE NOTE: We do not deliver on Saturdays, Sundays and UK bank holidays.
If a parcel is returned as undelivered we will offer a refund for the items only; the postage charge will not be refunded. If you still require the parcel to be resent a further postage charge is applicable.
We shall have no liability to you in respect of any delay or failure to deliver a product due to circumstances beyond our reasonable control, including (without limitation) delay or failure caused by adverse weather, strikes or transport problems.
We are not liable to pay refund for late delivery if the consignment does not have a complete and accurate address, postcode and telephone number for the customer.
We are not liable to pay refund for late delivery due to delays with the payment of duties and taxes or parcels being seized by authorities, or for delays caused by acts or omissions of customers details or other regulatory agencies.
If you have received your order with missing items, damaged or faulty goods please contact our customer support by email email@example.com within 24 hours of receiving the delivery. No claim will be entertained after this period.
From time to time we may offer special postage promotions and free delivery which will be available online. These offers are for the Mainland UK only, and exclude in their entirety the Scottish Highlands, Northern Ireland, Isle of Man and the Isle of Scilly. All International/European orders and higher postage delivery areas are also excluded. The postage promotions offered are for standard delivery, and may be available on a differing minimum spend value via our website. Postage promotions and in particular free postage offers are not applicable during sale periods and will be removed from the website without notice.
FREE DELIVERY OFFERS
On our free UK delivery offer we will send your item(s) out by a signed for carrier company for which you should receive your item(s) within 2 to 5 working days after dispatched, this will not be a guaranteed service and delivery times can vary. However if your item is urgent and you require a guaranteed service then you have the option of paying £12.00 for 48 Hours special delivery service item(s) will be dispatched the next working day from a confirmed order.This does not include weekends or public holidays. 48 Hours service is removed at busy times or when we are closed, and will also be unbelievable certain times.
Typically we will have your order dispatched within 24 hours of confirmed payment for next day delivery, this is not a guaranteed service as it depends upon the carrier company (this is ONLY for England, Wales and parts of Scotland).
Our standard delivery is charged at £2.99 per order if the value of your order is below £60.00, Orders Over £60.00 is Free Delivery.
When multiple items are purchased together and a free delivery is applied, if one or more items are subsequently returned, we will only refund you for the items returned minus the delivery charge that would have applied with the original order for the kept items.
International delivery only available to USA, CANADA, AUSTRALIA, shipment will be charged at £35.00. All EU shipments will be charged at £25.00 and you could be charged custom duty and tax from your own country of order which is outside of our control and you are liable to pay. We do not provide delivery to any other country outside this list.
Free International delivery to USA, CANADA, AUSTRALIA, AND EUROPE for all orders over £120.00. If multiple items are purchased together to get free delivery if the complete order is not returned and only part of the order returned the we will only refund the item price minus the delivery charge which you would have had to pay if you purchased goods below £120.00 which is currently as: USA, CANADA, AUSTRALIA, £35.00 and EU £25.00.
If, for any reason, you wish to do so you have the right to cancel any order you have placed. (Other than in respect of products made to your specification.)
The cancellation period ends at the end of 14 days after the day on which the goods come into the physical possession of—
(a) the consumer, or
(b) a person, other than the carrier, identified by the consumer to take possession of them.
Where the products have been delivered to you, you may cancel them up to 14 days from receipt of your goods, starting from the day after the products were received, in line with The Consumer Contracts Regulations. Products specially made or altered cannot be cancelled.
You can e-mail us at firstname.lastname@example.org. If you have contacted us to cancel before delivery of your products, please refuse any delivery attempt by the courier. If you have accepted delivery and you are in possession of the goods but wish to cancel your order, you must take reasonable care of them.
We will refund you the full amount on complete orders returned. We do not refund cost of returning the goods, in line with our returns policy. Any orders which are not received in compliance with the above will have the cost of return debited from any refund due.

For any items or orders to be returned a returns authorisation number has to be obtained by either e-mailing us at email@example.com which we will then provide you with the number within 48 hours (working days only) or by clicking on the link “returns authorisation” on the bottom of our webpage. Please do not send any items back until you have received the returns authorisation number otherwise no refunds or exchange will be effected due to the returned parcel not having location tracking in our warehouse or not having been linked to an authorised order.
If an item is unsuitable, it can be returned for a refund. Please ensure the goods
have been returned unworn and in saleable condition within 14 days of order cancellation notice.
"The consumer must send off the goods under paragraph (2)(a), or hand them over under paragraph (2)(b), without undue delay and in any event not later than 14 days after the day on which the consumer informs the trader as required by regulation 32(2). of the consumer contracts regulations 2013"
All costs of returning the goods will be incurred by the customer. Only the cost of goods are refundable and not the postage charges.
The item is your responsibility until it reaches us. For your own protection, we recommend you use a delivery service that insures the parcel for the value of the goods. We aim to process all refunds within 14 days.
Note: all products are checked thoroughly before dispatch. Please take care when trying on items of clothing and ensure that you are not wearing make-up, perfume, or a deodorant which may leave marks or a scent on the item.
We will be unable to accept the returns of any items where there is evidence that these instructions have not been followed. Refunds will not be given for products that have been damaged whilst in the care of the customer due to misuse or negligence.
We will refund most items provided they are returned complete, unused and in their original packaging with all appropriate labels and tags intact within 14 days of receipt. NO refund or returns accepted for any items that has been made for you from our semi-stitched section or any garments that have been altered to fit you.
Please ensure your returns form is completed in full and any supporting information written on a separate sheet of paper and enclosed in the parcel. If you have misplaced your return form, you can email firstname.lastname@example.org and we will email you the form within 48 hours. All items being returned back to us need to be adequately packaged and labelled.

You can return your goods via a Post Office using second class recorded delivery for parcels less than 1kg in weight, thereafter first class recorded. Please ensure that you retain the postage receipt and obtain adequate insurance to cover the value of the returned goods. As we cannot accept any liability of items until they have been received by our offices.
International returns can be made from your local post office or courier company, should you need help or advice regarding this please e-mail us at email@example.com
We are unable to provide a free returns service, and therefore customers are required to cover all return postage costs.
Please note that goods received without a RAN will incur delay in refund and may not be refunded.
In an unlikely event of a faulty or incorrect item is received, please contact customer services as above who will issue you the RAN .Please return the item using SECOND CLASS RECORDED DELIVERY ONLY. We will only reimburse the cost amount for this postal service and not for any other postal/courier service. We cannot dispatch a new item until we have received the wrong/faulty item back and inspected its condition.
Refunds are processed within 14 days of receipt of any returns. A refund can only be issued via the original payment method.
If an item is out of stock or you cancel your order before dispatch, a refund is issued within 5 working days. If there is an issue where a refund has not been received please e-mail us at firstname.lastname@example.org
Any courier claims can take up to six weeks to refund upon submission of all relevant paperwork.
During peak times such as sales or busy festive periods, processing refunds may take slightly longer.
STOCK AVAILABILITY We always try and ensure that all stock is available when ordered. We have high demands for our goods and sometimes we run out of stocks faster than we expect. To avoid disappointment we advise you to order as soon as possible. Under these circumstances we do not wish to delay your order and may do any of the following.
At the time of dispatch, if an item(s) is out of stock, we try to contact you by telephone or e-mail. In the event you are not reachable a refund may be given for the item and the remainder of your order dispatched. Please make sure to provide complete contact details at the time of order. In case of wrong contact details provided or no response from customer, Shifa Collections reserve the right to cancel out of stock items and send rest of the order.
Alternatively, if the customer supplies incorrect telephone numbers or incorrect address details, the order may not be sent out until we are able to make contact for verification.
The customer card details must match the delivery address. If there is a discrepancy we will need to verify the card and address match before dispatching the shipment. This may delay the arrival your order. We cannot be held liable for delays to deliveries in these cases.
In the event that more than one item is missing we may cancel the order and issue a refund in full.
DAMAGED GOODS / PARCELS
In the event that the parcel has been damaged or tampered with on delivery, do not sign for the parcel and return it to the courier.
If you decide to accept a damaged parcel, then you need to record "damaged" on the receipt and obtain the courier’s signature. Open the goods in the presence of the courier and notify him of any damage/missing items. A refund for such an event will depend upon the time taken by the courier to resolve the claim.
Keep ALL packaging as this will be required for any claims against the courier(s) for damaged/missing items. In the event of damaged items please contact us on email@example.com within 2 days. Any notification after this date will not be considered.
We shall refund or replace (if the item is available) free of charge any goods lost in transit by our carrier, subject to completion of their claims process.
In the event that you receive an item which is damaged please contact us within 24 hours on firstname.lastname@example.org and we will try to resolve this matter with a repair, refund or replacement.
Refunds will not be given for products with damages caused by a customer's misuse or neglect.
MISSING ITEMS / PARCELS
A claim must be placed within 2 days of receipt of your order via email at email@example.com
All packaging must be retained in order to process your claim.
Should you accept a damaged package you will be subject to any delivery company’s investigations before we can finalise any claims.
Where the courier company establishes that delivery has been made, we would then need to adhere to their claim procedure. This will require the customer to fully complete a missing parcel claim form which will be provided directly by the courier.
Unfortunately we cannot pursue any claims until all appropriate forms have been returned to the courier company.
CLEARANCE / SALE SECTION
The reductions shown are reductions from the original marked price charged on the website. We also supply a recommended sale price as guidance on the normal selling price. Occasionally these prices may have applied more than six months ago.
The offer of free delivery is not applicable on sale items.
From time to time we may offer Free Delivery on orders purchased online at www.shifacollections.co.uk This excludes Scottish Highlands and Islands; Northern Ireland; Isle of Man and Isle of Scilly. Also excludes international orders and higher postage delivery areas. This is only applicable on standard delivery.
Promotional offers, If multiple garments are bought on a promotional offer and then one item(s) returned and there was condition attached to the offer IE orders over certain amount then the item kept will be charged at the full rate unless the kept item falls within the condition, refund will only be made for the difference from the price of the garment kept OR,
All promotional offers must be returned in their entirety.
The offer of free delivery is not applicable during sale periods.
FABRIC & EMBROIDERY
Many of our items are hand embroidered and therefore fragile in their usage. These garments should be worn with care and are mainly for special occasion wear.
Please note that due to hand dyeing methods used the colours are not guaranteed. A garment may have variations in patterns due individual dyeing methods.
Any displacements to stones, sequins, beads or embroidery and small marks of glue cannot be deemed as defect in the garment but is caused by the very nature of the work. Any small marks will come out after first dry clean or hand wash In these cases postage cannot be claimed in exchanges or refunds. All care has been taken to ensure that the product description and specification are correct at the time of publication; however specification and details may change.
Measurements given are approximate as all our garments are hand produced.
Please ensure that the first wash is 'Dry Clean' only, Heavy embroidered items can only be dry cleaned. Please see each individual item’s description for approved cleaning instructions. If hand washing is an option, please wash items separately. We cannot be liable for any damage to your garments due to not complying with the washing instructions given.
All clothing with embossed or rubber prints should be reverse ironed.
Outfits may have a smell of paraffin which is due to the process used to dry clean garments after embroidery. This smell will evaporate once the garment has been removed from packing and allowed to air.
Specially commissioned items can only be cancelled within 3 days of placing the order. We cannot offer you a refund or cancellation after this period of time. Your statutory rights are not affected.
Some countries have import restrictions on certain products or materials. You are responsible for checking with local customs authorities before placing an order for international delivery. We cannot accept any responsibility for any delay or failure in the product reaching you due to any customs, legal or regulatory restrictions. We may, at our discretion, refuse to process an order for any product if we believe that delivery may be subject to any restriction in the destination country.
All prices are quoted and products sold by us are on a duty unpaid basis. You may have to pay a customs fee or import duty before the product can be delivered to you. Further taxes, fees or levies may also be payable depending upon the local laws of the delivery jurisdiction. We cannot take any responsibility for this and it is your duty to verify any additional costs for international delivery to your preferred jurisdiction prior to placing an order.

We do not offer next day or timed deliveries on international orders.
We are unable to offer a free return service; therefore customers are requested to cover all return postage costs.
